Reform of Affirmative Action in Federal Procurement (DFARS Case 98-D007)

This interim rule was issued by Departmental Letter 98-018, dated August 6, 1998, effective October 1, 1998 (http://www.acq.osd.mil/dp/dars/dptltr/98018.pdf). [also available on FARSite, Changes, DL]

The rule amends DFARS guidance concerning programs for small disadvantaged

business concerns. These amendments conform to a Department of Justice (DoJ) proposal to reform affirmative action in Federal procurement, and are consistent with the changes made to the Federal Acquisition Regulation in Federal Acquisition Circular

97-06, dated June 30, 1998, effective October 1, 1998. DoJ's proposal is designed to ensure compliance with the constitutional standards established by the Supreme Court in Adarand Constructors, Inc. v. Pena, 115 S. Ct. 2097 (1995).
